Legal Question in Criminal Law in Texas
Texas Traffic Laws concerning a recent citation.
I have a general question conscerning Texas Traffic Laws. Recently I was ticketed for traveling 20 mph over a posted speed limit (60/40mph). The current date was 12-1-97, but the police officer placed 11-31-97 on the citation.(which is no such date). It would appear there is a technicality that I might tell the judge, but I am unsure how I should approach him/her. What Texas laws, if any can I use in my behalf?
1 Answer from Attorneys
Traffic citation date
You probably have nothing to argue since the exactitude of a date only impacts the statute of limitations - and an inadvertent error like 11/31/97 would probably be corrected by the judge, However, you might want to discuss this with a City Attorney or whoever prosecutes traffic tickets in youyr area. They often wlll resolve the case administratively rather than go to all the trouble of haveing to prove up the actual date,
