Legal Question in Criminal Law in Texas
Can a theft under $50 be deferred in Texas? Also, if I was put in handcuffs for a Public Intoxication, then ran and now I am being charged with a PI and theft of under $50 and this is in the JP Court, what happened to the evading arrest?

Yes, theft under $50 can be deferred.
The evading arrest is a Class B misdemeanor (unless accompanied by certain aggravating factors). It is handled at the county-court-at-law level. I would have expected for you to be charged at the time, and required to post bond on that charge as well. You can call the clerk to determine exactly what the charges were.
