Legal Question in Criminal Law in Texas

theft of a flag at 17, now I'm 25

In Plano I was 17. I pleaded no

contact, got probation and

community service. I am turning 21

next month. Can I get this theft

expunged, I also got a DWI at 19.

I've served my probation. am trying

not to build my career and I have to

explain these two teenage bad

decisions. I need advise and help

Generally speaking, if you take a deferred probation on a class B offense or higher, you can never get it expunged. You can file a petition for non-disclosure to seal the record from most private entities. If you take a deferred on a class C, you can get that expunged. There are specific requirements but these are the general rules.

Generally, non-deferred probation is on your record forever, you can't expunge it or seal it.

The DWI will be there forever most likely.

The theft might be able to be sealed depending on which offense you were charged with and whether you were on deferred or straight probation.
