Legal Question in Criminal Law in Texas

theft

I am currently on probation for theft over $50 in Texas.

I recently stole a lighter, and a soda from a gas station and was caught. I was notified that Ive been charged w/ theft under $50 in the same county.

I am afraid of what may happen to me in court, seeing as how Im currently on prabation, it may not look real good.

What is the most and least they could sentence me with? Am I looking at jail time, or just a ticket and a fine?

And, should I tell my Probation Officer that I see now, about this before she finds out?

Thanks.

Re: theft

Unfortunately, that is going to be a very expensive lighter and soda.

You need to hire a lawyer before you do anything else. The attorney might be able to work the lesser offense into the current probation, and extend the probation.

The probation officer is probably going to revoke you, and you will spend a few days, at least, in jail.

How long probably will depend upon whether you get that lawyer right away, or wait around to see what happens.
