Legal Question in Criminal Law in Texas
Theft By Shoplifting
My 15 year old just got a ticket for theft by shoplifting of a shirt under $50. Questions:
1) Is this a Class C misdemeanor?
2) What are your recommendations when we go to court?
3) Will this show up on her record?
Thank you.

Re: Theft By Shoplifting
Yes, theft under $50 is a class c misdemeanor. So your child is facing up to a $500 fine. However, you really want to get deferred probation. This way there will be no conviction. However, it will show up on her record as an arrest. If you get deferred, upon successful completion your child can file a petition for non-disclosure. This means that only law enforcement and other specified government agencies would have access to the arrest records. I recommend dressing well (like going to church) and being on time for court. I hope that this answers your questions.
Sincerely,
Michael Palmer

In addition to Mr. Palmer's advice, you may want to check the court's website, or call the clerk. Some courts have a diversion program or Teen Court, where the teenager does community service, and the entire matter gets wiped from the record.
