Legal Question in Criminal Law in Texas
Theft or not?
I sold a ring to a friend (for his girl)of mine that was also my roommate for 2500. He paid me 1100 in cash and was going to pay off the rest. However, they up and moved out over a year ago and I heard nothing from them and or recieved anymoney. I just found the girl (wearing the unpaid for ring) and she refuses to pay and or give the ring back. I have the reciept for the ring along with the rings info/ identity card. So I can prove it is my ring. There was no paperwork filled or even signed stating that I was selling it to them and at this point I really feel as if they have stolen it from me and if anything consider the money they have given me as ''rent'' for the ring for the last year and a half.

Re: Theft or not?
This a civil matter, You file a lawsuit against him for breach of contract. I do not see a theft case since there was no intent to steal at the beginning of the transaction.
