Legal Question in Criminal Law in Texas
I have a theft under $50 in Texas and I was wondering if I was convicted can I still get the charge taken off as far as background checks are concerned for employment?

The general rule is that if you were convicted you are not eligible for
expunction unless your receive a pardon. However, the law is poorly worded regarding Class C misdemeanors. You need to consult an attorney who specializes in this area.
