The statute of limitations for all misdemeanors in Texas is 2 years. That means that the State has to charge you within two years following the criminal incident. This doesn't mean that the case has to be disposed of within 2 years, just that the State has to charge you within that time frame. It sounds like you ultimately got some sort of probation (or deferred prosecution) and failed to pay the restitution. If you failed to comply with the terms of the probation, then the State is probably within its rights to file for a motion to revoke (or in the case of a deferred prosecution, to refile the charges). You should discuss this with a local criminal defense attorney.
