Legal Question in Criminal Law in Texas

Trial of class c misdemeanor case

My son received a class C misdemeanor ticket for discharging fireworks in the city limit, which is not found in the city code. Can I defend him in court or do I need an attorney?

you can defend him if you are a licensed attorney. If you are not a licensed attorney, that would be considered the practice of law without a license, and is actually considered a crime.

You would need to hire your son an attorney or let him defend himself, since individuals do have the right to represent themselves ("pro se") in criminal proceedings.

It is illegal for a non-lawyer to represent someone in court. Its called practicing law without a license. Regardless, you need a lawyer if you plan to have a trial.
