Legal Question in Criminal Law in Texas

Underage Public Intoxication

My daugter, at age 17 was issued a citation for public intoxication. She has a trial before a jury, since she's underage I thought these cases just go before a judge? Should we hire an attorney or just appear in court?

Re: Underage Public Intoxication

Your daughter may be under age for being able to legally drink in Texas, but she is an adult for purposes of criminal law and the Courts. I would advise anyone who is charged with a criminal offense to retain counsel. First, the person prosecuting your daughter is a trained attorney who works for either the County Attorney, City Attorney or District Attorney's office. If your daughter attempts to represent herself, she will be out qualified from the start. Bottom line, hire an attorney that handles criminal cases.
