Legal Question in Criminal Law in Texas
Vandalism to car
My common law husband for 30 years and I have been separated for 1 week. During this week I am staying with my son and my daughter in law. The X came and did $6000.00 of damage to my new 2007 vehicle. We have pictures of him doing the crime and a police report. Can I sue him for damages or what would be the next step to take? I told police I will press charges. Thank you

Re: Vandalism to car
In addition to Mr. Dorbant's response, when you file for divorce, you can include this as a cause of action in the divorce.
Re: Vandalism to car
You can sue him in civil court - the proper place for you is Bexar County Court at Law and you can have criminal charges filed against him as well. I would go with both, but ask the prosecutor on the criminal charge to require that you be reimbursed as a condition of your X's probation! They can do this and your X will be required to pay the damages.
