waive right to appel
my boyfriend waved his right to appell and waved a jury but he wants to know if he can now have his attorney go in and put in a motion for a sentence reduction and what is the average sentence for a first time sex offender?

There is no 'average' sentence for a sex offender conviction. Under Texas law there are numerous sex offenses, and each one is mitigated or aggravated by the specific circumstances of the case. Further the court can consider factors besides the first offender status, including his background and his plans for the future.
His attorney can petition the court for a reduction, however, it sounds as if your boyfriend has already disposed of his avenues of relief. These are questions which are properly posed to his attorney.
