Warrent

I have a waarant out and its almost been three years since it was issued and the carge is a juvenile charge and im an adult now. i talked to a police officer about it because ive been pulled over and havent been taken in and she said that since its a juvenile charge and im an adult they wouldnt know where to put me and thats why i havent been taken in. My parents have said that the warrent goes away after 3 years and i was wondering if it really dose or will the warrent not be active but it will still be on my record? Because all i really want is for it not to be on my record anymore.

You are right to try to correct this situation. Warrants, per se, do not have limitations period. There is caselaw however, that says that if you are in the state, and easily located, and an unreasonable amount of time has passed, then the warrant should be quashed.

Additionally, the information you have provided makes sense -- the police have a practical problem about where to incarcerate you -- but I would not risk it, as a cop might get creative and figure out a way to hold you.

I suggest you hire a lawyer to see about getting the warrant quashed.
