Legal Question in Criminal Law in Texas
My wife is on probation and she was revoked because she did not take a ged test two months before she was to finish her probation and was arrested for it even tho she has taken the test last weekend and will not be getting off till Feb 8 2011 can they give her more time on probationeveb tho she has done everything the judge set down for her
1 Answer from Attorneys
She violated probation by not following the terms of the probation. The judge has the option of allowing the state to plea bargain or handling the violation. The probation can be reinstated and terminated successfully, reinstated and extended, terminated unsuccessfully, or revoked. If that is the only violation (which would be rare) then I would think that the court would simply terminate the probation. Hire her a lawyer to talk on her behalf.
