Legal Question in Criminal Law in Texas
New Year Nightmare
I was charged with P.I (public intoxication) misdemeanor-C, and Assault (fighting), misdemeanor-A, on New Year day, in AUSTIN TX. Spend 36hrs in a holding cell before setting bond.
What I would like to know is how I can get the case dismissed. I was told from a friend who witnessed the incident said the other party did not press charge. And as for the P.I charge, I had only one beer or less before this happened. No testes were conducted at the time. So how can they prove I was intoxicated?
Also if it helps, this is my first offends.

It may not be dismissed. The police may have evidence you are unaware of; but in any event, to keep a clean record, you should not try to handle this yourself. Get a lawyer.
