Legal Question in Discrimination Law in Texas
fired from my job because of my ethnic background
After many tastles, racist remarks about my ethnic background I was finally fired for no reason. 2 days later my cousin was fired from the same company. We decided to send a letter to the owner of the company complaining to him about what happen. The other two F@I managers decided to sign on the letter to the owner because they felt that they are next on the list. The owners agent (vice president of the company with the CFO) came to San Antonio to hear about our complain. We met with them and told them that we are not seeking to file a lawsuit unless we have to (which was the honest truth). Those two executives were extremely nice and asked us to sign an affidavit about what the general manager did. They promised us to fire the General manager ( which they did) and to give us back our jobs. Today the vice-president told us that he can offer us a salesman job but can't give us our positions back. The 2 other people that were still working are still there. We are real upset with the company and are ready to file a lawsuit for as much money as we can and we want to take this all the way to court. What is the amount we can sue them for and what are our chances of winning such a case?

Discrimination cases have a procedure that must be observed before a formal lawsuit can be brought. The first step is to make a formal complaint with the EEOC. Once the EEOC obtains the complaint it investigates the matter and makes a determination whether it believes that discrimination played a role in the decision to fire the employee.
