Pending Eviction
My husband and I rent an upstairs apartment in Texas, we pay over 1200.00 in rent. We have two children our kids make normal kid noises and are usually in bed by 8:30-9pm daily the downstair neighbor call every time they hear any noise and it's to the point they are harassing us about our kids ''being kids'' and I want to know if their is any law to protect us from this. Some kind of Fair Housing Act or something because it's not fair to us to have to put our kids in a cage and not enjoy there home at this time either but that's basically what there asking us to leave. We recieve a threat from management today and I would like to know what we can do about this if anything??

Mediation.
Kids can be obnoxiously annoying to rental neighbors, especially if they live above. On the other hand, some people are overly sensitive and the more the noise annoys them, the angrier they get.
If neither of you want to move [or swap apartments], it might be in the apartment's best interests to let you out of your lease, let them out of their lease, inform the neighbors that they can't continue to call you like that and remain in compliance, or a whole host of things.
Try the mediation and if it doesn't work, then you may want to contact local counsel.
