Legal Question in Discrimination Law in Texas

Recourse for age descrimination

I lived in Texas and worked for a company there. This company is a division of a company in California. For years they have cut back salaries of older workers and more recently (1998) they let several of us go (mostly over 50) for "cost cutting". They did not hide this. The CEO sent a fax to our General Manager to "cut costs" - he posted it on the bulletin board everywhere. A week later we were gone. We were replaced with young temps the next day. Most of us were managers or supervisors. We contacted a lawyer and this lawyer immediately took our case. We waited 6 months to file (for benefits to run out). That was Dec 1998. Lawyer contacted appropriate Gov agency EEOC or something... but there are delays .. lot of activity in summer of 1999. but now they say "waiting for the Gov to approve lawsuit". We are filing in large city in Texas. Question is: Is this delay normal? I want to bring my old company to its knees because they are still continuing this practice.

In cases of discrimination the EOC must be contacted and a complaint filed agains the company. The EOC then investigates the company to determine whether or not to file federal charges. Once the investigation is complete a letter will be sent to the complainants. The letter is a "Right to Sue" letter. After this letter is received than the case may continue. It sounds like this is going to be a long investigation so it may be some time before any action is taken. This type of lawsuit takes a long time and it may be 2 or 3 years before you see the inside of the courtroom. Request that the attorney handling the case keep you updated every 2 or 3 months. If this is a class action suit it could take a lot longer.
