Legal Question in Discrimination Law in Texas
Should I Know That They Thought I was BLACK TRASH?
In the summer of 1992, I was not allowed to purchase a home in an upsacale HOuston neighborhood because the seller told the agent that she would not sell her home to 'black trash'. I filed a discrimination lawsuit, and lost to a summary judgement this past August because I did not file the lawsuit until 3 years after the discrimination happened. It appears statute of limitations had run out. However, I did not find out about the bigotry until until 1995...3 years after it happened. It had been concealed from me until then. 30 days has passed since the ruling was handed down. My attorney does not to appeals. Is it too late to appeal? What can I do call this issue to the public attention? These agents are still practicing realestate in the state of Texas, and the sellers, well they sold to a caucasian couple who defaulted on the loan, so they got the house back. What are my options?

Good for you, bringing suit. I'm sorry it lost, buttake comfort in knowing that the other side probablyspent more defending it than you did bringing it. Ifit's any consolation, consider their legal expense apunishment.
In Mass., we have a Commission Against Discrimination that will send out testers when they feel there's a goodreason. A white couple with N children will go out andlook at a home and then a black couple with the same number of children, with roughly equivalent down paymentsto offer, etc. will also be sent out. They make the case. You don't profit from their lawsuit but they have more power and wouldn't have that statute of limitations power.
Is there such a commission in Texas?
Certain civil rights violations are federal law, by the way.I betyour lawyer is doing what's best and sometimes that means knowing when you can't do anything more.I'm sorry to see them get away with this, but maybe it's bestleft for the next person to deal with.
