Under age public drinking
Article 106.04 � Consumption of Alcohol by a Minor of the Texas law states that a minor can drink alcohol in the presence of their parents. Is this valid for public drinking or only in the home?

Your statement would require more specifc facts to provide a more clear opinion. Generally, consumption of alcohol by a minor under the Texas Alocholic Beverage Code does NOT allow for a minor (someone under the age of 21) to consume alcohol. There is a potential affirmative defense, which may be applicable in such a specific case.
