Blood Evidence
If you have an accident where you are knocked unconscious and no one else and only your car is damaged... If the hospital takes blood to treat you, can the state or prosecution use your blood alcohol level from the hospital as evidence against you?

Blood alcohol levels may be used by the DA in a criminal charge (if applicable). As for the admissibility of the actual test results, there is no clear cut answer. The possibilities are numerous due to the variables that are invovled with the taking of the blood to the chemical testing.
