Legal Question in DUI Law in Texas

Charged with a DWI?????

I was stopped and taken in to jail I passed the breath test 5 times with a .oo% passed the Field sobriety test I Was not given any other tests The officer said I could give you a urine test but I am not going to. I went over the line a few times that is why I was pulled over I was arguing with a friend on the phone and not driving well I admit But I was not drinking at all They ticketed me for no seat belt kept me in holding a few hours and let go. Come to find out I am charged with a DWI??? I had moved after the incident so papers not forwarded until after the court date. SO Now I am in more trouble. Plus they are saying I was bonded out... I was not bonded out A friend of mine went to check on a bond but they told him I did not need a bond because they were letting me go. Never saw a judge or bondsman ALso the description they have on the arrest deal online is my name and DOB, but the person they describe is not me. I do not know what to do at this point. I know I need an attorney but I really cannot afford one. But what can be done Now there is a bench warrent for failure to appear and then the bond company deal what do I do about that? I feel it is a bad mix up of records. Thank you for any advice you can give

Re: Charged with a DWI?????

Hello there,

Yes, you do need a lawyer and from the information you have given it sounds like you have many good defenses.

But, you are having problems with your bond. You or your attorney need to contact the Sheriffs department and the County Clerk to get the information on when you were booked into jail and how you were let out. If you didn't sign a bond agreeing to appear on a certain date or a date to be determined the failure to appear should be dismissed and your bond amount should be lowered.

Bottom line is that you need an attorney that you are comfortable with and is going to work hard for you.

If my office can be of any further assistance feel free to contact us.

Sincerely,

Erick Platten
