Legal Question in DUI Law in Texas

dismissed not convicted

About two years ago I was stopped for a DWI---had to stay

overnight---but, it was dismissed and no community service or anything. It is not expunged yet because it costs so much. I have to fill out some forms to go to court over a very minor car incident (nothing to do with drinking)---I have to fill out questions---

it asks if license was suspended and it asks if convicted----Since I was not convicted----do I have to say my license was suspended? I used an occupational till court---then, it

was all over. What do I have to admit if it was all dismissed?

Re: dismissed not convicted

Hello there,

On the form you are going to have to state that your license was suspended.

However, you can have the arrest expunged from your record.

The State has 2 years to file a misdemeanor case.
