Legal Question in DUI Law in Texas

Old DUI

I was charged with DUI back in 2000. I decided to plea deferred adjudication b/c i did have a couple of drinks and saw it as an easy way out. My case was dissmissed. I never had to pay any fines of did any type of propation. Since the case was dissmissed I tought the record would not be an issue. However, I recently graduated from a private university but come to find out Im having a hard time landing a good job. Employers always seem to ask me if I have ever been arrested. I used to answer no and then the employers would do a background check and then they didn't want to touch me with a ten foot pole so now I mention on my job applications that I have been arrested and the reason why and now I can't even get a second interview. I have not received a ticket or ran into the law since my DUI charge back in 2000. Will I ever be able to clear my record? Will I have to get another lawyer? What are my options.

If the case was outright dismissed, and not a deferred dismissal, you may be able to get it expunged. This would be your best option. If not, then you should be able to get the record sealed. Get a lawyer.

You most likely will not qualify for an expungement as being placed on problation rules out an expungement. However, you should be able to have the record sealed.

For most employers this should be enough; however, if your applying for any law enforcement related jobs this will not help you as law enforcement will continue to have access to the information. Bottom line. Consult an attorney. If you have any additional questions feel free to email me.

Most people mistake DUI for DWI and neither can be deferred. Therefore, you can neither seal or expunge the record unless your case was outright dismissed. It seems from your facts it was not dismissed. It sounds like you where given time served and the case was over. If you are not sure hire an attorney to check and advise you. If it was a DUI or DWI conviction it is on your record for life.
