what constitutes a dui. My son got a dui, he is 17 but his breath test blew a .064. He was taken to jail. was that because he was a minor and drinking. so wouldn't he just get a ticket instead of a dui charge since he wasn't legally drunk. I thought you had to be legally drunk to be taken to jail. He got no other tickets was stopped for tail light but on the ticket it just warning. can you tell me if this is dismissable?

DUI is driving under the influence, DWI is driving while intoxicated. Two different charges. Which is why he was not charged with DWI. At 17, he is a minor under civil law, but an adult under criminal lawyer. The tail light was the probable cause to justify the stop. He needs a lawyer.
