Can a police officer legally give you a dui without taking you to jail and without giving you a breath test? if so, is this worth fighting in court?

Based on what you have written, a police officer can charge you with any criminal violation. It is up to the prosecuting attorney to be able to prove the case beyond a reasonable doubt to fact finder (e.g., the jury or judge).
