My brother was booked in to our local county jail on DWI 1st offense Oct -2 years ago. He said that if the state doesn't prosecute him in 2 yrs he's free as a bird. What does Texas State law state about how much time does the state have before statute of limitations goes up on DWI 1st charge?

The state has two years to prosecute a misdemeanor. If he was out of the state for any period, the statute tolls for that period of time.
