Legal Question in DUI Law in Texas

DWI #5 or 6

My brother got another DWI in Dallas County while he was on Probation in Collin County. He is now in jail for probation violation in Collin and they are talking about SAFP.. His lawyer is trying to get Dallas County to go with it also. My question is what do you think we should expect? He has a drinking problem he is not a criminal.. This last DWI he received he was pulled over on the side of the highway sleeping because he realized he was to drunk to drive.. I realize him drinking is in itself a violaion but is there not anything else that can be done.. He has never had to serve prison time. Also, what do you know about shock probation?

Honestly, if this is his 5th or 6th DWI, AND he is on DWI probation, then his lawyer is very good if he can get both counties to accept SAFP. This is often a situation involving significant prison time. He has two problems. He has a drinking problem, and a problem staying home when he drinks. Not likely he has any chances left after this one. If he doesn't stop drinking, then he needs to learn to drink at home. If he doesn't the state will take the choice away from him.
