Can my husband be charged with a DWI if he was not behind the wheel when the police arrived. The was a minor accident involved, and he was checking to make sure no one was hurt. All of this took place on private property

Hello there,
In Texas in order for one to be convicted of a DWI one must be intoxicated to the degree that they have lost the normal use of their mental and physical faculties and they must also be observed operating the vehicle on a public road, highway or beach.
So if the accident only happened on private property it is not a DWI.
