Legal Question in DUI Law in Texas

In my research of Texas enhancements and penalties for a third DWI, I found information that I am unclear on. Perhaps you can help. Is the ten year length between a prior conviction and a new offense based on the actual prior conviction date or some other date? Perhaps the release of probation date or confinement release date??? I'm not sure???

Effective September 1, 2005 there is no longer a 10 year rule for prior DWI convictions. In other words, an individual may be prosecuted for any prior DWI conviction no matter how old the conviction and no matter how many. Prior to September 1, 2005, the State could only use a prior DWI conviction if it was within ten (10) years of the new DWI, however, that is not the case anymore.
