Legal Question in DUI Law in Texas

Expungement

I was convicted of a felony DWI in 1987, served my probation preiod, went through a rehabilitation center and have not drank alcohol since 1987. Can this be expunged from my records? If so, can I obtain a state license to become a Drug and Alcohol Counselor? I am currently enrolled in classes to do so, so this is very important for me to know before preceding further in this field of study!

Re: Expungement

Since you were convicted, the conviction cannot be expunged without a governor's pardon. Due to the age of the conviction, the probationary period, and your conduct since then, it might (long shot) be possible to get the conviction set aside. If so, you would be eligible to apply for an Order of Nondisclosure.

Nondisclosure orders only shield the records from the general public, not most govt agencies. As for the counselor license, you should check directly with the licensing agency to determine their requirements. It seems that it would be an asset, not a hindrance, to have a person with your background in alcohol counseling.
