HOw to figure BAC

I blew a .14 first time, then a .16 second time. Which number do they use for assessing DPS surcharges in Texas. A medium of the two?

Criminal Courts in Texas use the lower score when claiming that someone blew on the intoxilyzer. However, I don't believe the scores above are within the proper compliance on the one test.
