You are probably not going to get DPS to grant you a hearing because the request was a day late. If this is as a result of a DWI arrest, 40 days from the date of your arrest, you license will be suspended for a period that is determined by whether you blew and failed, refused to blow, and whether or not you have prior arrests or convictions for DWI.

Your lawyer should be able to explain your ability to get an occupational driver's license from either a court in the county of your arrest or the county you live in. The matter is up to the judge with jurisdiction in your case, and can be granted for a minimum of 4 hours a day and a maximum of 12 hours.
