My husband had a single-car roll over, and was injured and taken to the hospital. He was charged with a DWI, but no tests were administered at the scene, only bloodwork for medical reasons at the hospital. Can that bloodwork be used againt him in court?

The short answer, is yes, his blood work could be used against him in the prosecution of a DWI charge. The State has to comply with the rules of evidence to get this information in at trial, but assuming they do, then it is likely to come in. Your husband should consider speaking with some local criminal defense attorneys about his case and how to attack this arrest.
