Intoxication Manslaulghter and 2nd DUI

My son was convicted of a DUI in Florida when he was 17.Now he is involved in a case in texas. He has been charged with DUI and intoxication manslaughter. He was driving crashed into a poll killing the passenger, I understand that this is serious and carries large penalities. I wanted to know what the typical sentances are for this crime.

I don't know about Texas law, but having handled many of these cases in Florida, your son would be looking at a Second Degree Felony for DUI Manslaughter and would score out to anywhere from 11 to 15 years. Normally, on a plea, he could get the bottom of the guidelines. However, in light of the fact that he has a prior DUI, Texas may ask for more. Also, a lot of the case will turn on what the family of the deceased victim wants to see happen.
