Legal Question in DUI Law in Texas

minor in comsumption

My son was given a mic ticket after being at a friends house that was having a small get together. Officer arrested one boy and called the parents of the other children. My husband and I were in Spain at the time so we weren't called. Officer couldn't take my son to the station to test him for alcohol. Told my son he was guilty by association. What should I do?

The ticket provides a court date. You need to appear with him.

Does he want to fight the ticket? If so, you need to ask for a trial date. If not, ask the court about Teen Court or deferred, where in exchange for community service hours, the ticket will be dismissed.

If you are uncomfortable handling this yourself, hire a lawyer in your community.

You need to also know that your son's driver's license will be suspended for a minimum of 60 days whether your son gets deferred adjudication, or not. It would be my advice that you hire an attorney to go with you and your son, to advise you what to do. By the way, make sure it is an attorney who does DWI, and/or is familiar with these kind of cases. Good Luck.
