Legal Question in DUI Law in Texas

Probation guidelines

My bf is going to be placed on probation to avoid getting a DUI on his record. He currently lives in CO, but has to move back to TX to begin probation. He got picked up in Williamson county. However, he will be getting a job in Bexar or Guadalupe county. He was told that he has to have a permanent address in Williamson county and must work in the same county. Is this true? If so, can he appeal?

I am sorry, but if your boyfriend got a DWI in Williamson County, he cannot take a probation to avoid a DWI on his record, unless he has been accepted in the Pre-Trial Intervention program. If he has been accepted in that program, then yes, he will have to live in Williamson County or in one of the surrounding counties in order to complete the program, and I am sorry, but Bexar and Guadalupe Counties are not close enough in order to remain in the program. But, if he is just taking a probation for a DWI thinking that he will avoid a DWI on his record, then he might need to talk with another attorney to discuss the case before taking the probation.

I am sorry, but if your boyfriend got a DWI in Williamson County, he cannot take a probation to avoid a DWI on his record, unless he has been accepted in the Pre-Trial Intervention program. If he has been accepted in that program, then yes, he will have to live in Williamson County or in one of the surrounding counties in order to complete the program, and I am sorry, but Bexar and Guadalupe Counties are not close enough in order to remain in the program. But, if he is just taking a probation for a DWI thinking that he will avoid a DWI on his record, then he might need to talk with another attorney to discuss the case before taking the probation.
