Legal Question in DUI Law in Texas

Public Intoxication on Private Property

On April 17 I was parked in the driveway of my son, ex-husband and ex-mother in law's home. I was in that home for 25 yrs. and remarried. When I have trouble at home (he is convicted of family violence) I get some beer and go there. If no one is home I stay and sleep in my car. If someone is home I go in to sleep on couch till morning. Three black boys came up from the backyard (trespassing) and I got in an arguement with them because there has been alot of vandalism there. A creek and acreage in back so no reason for them to be here. They called police and instead of arresting them- arrested me for public intoxication!!! Far from public property!!
