Legal Question in DUI Law in Texas

Salesman has pre-existing DWI, but needs to travel for sales calls

Well-adjusted employee has a DWI

(fairly mild, no breathalyzer test, or

testing of any kind for that matter)

on his record from before he

started working here. He's been

doing a great job, has built a

relationship with quite a few

clients, and is really just now

starting to come into his own.

We just found out today that

insurance won't cover him, and

furthermore that we may be liable if

we send him on sales calls and he

gets in an accident - even if it's not

related to drinking.

Our only option would be to let him

go, because traveling is an

absolute must, but we'd like not to

do that. Do we have any other

options on the table? Are we really

liable for anything that happens to

him on the road, simply because of

his previous DWI?

I would appreciate any help given

on this subject. He's a good guy,

supporting a new baby and a wife,

and we really don't want to kick him

out into the current job-hunting

market if we can afford it.

Get him to get an SR-22 insurance, that should cover you
