My son was arrested for his first dwi and was found guilty, as part of his probation because he dosen't own a car and had trouble waking up to do the home breath test (he works nights) they are making him take the drug Antabuse. He has had no record of problem drinking and this was his first offense can the court make him take a drug for a sickness that he does not have. (Alcohoism)

Probation officers have some leeway in setting the terms of probation, and may have authority to do this. He had an option of the home breath test, and chose not to do it. You may want to consider retaining an attorney for him to contact the PO and determine if less intensive options are available.
