My son, got hit by a drunk driver while riding his bike, Does me and his father get any kind of pain and suffering or anything?

In order to get damages for an injury, you must make a claim either with the drivers insurance company or by filing suit against the driver and any other responsible party..

Generally it is not a good idea to file a claim with the insurance company without having your own attorney. This is because the insurance carrier will not want to pay you any money and if it does will want to pay as little as possible.

Whether you are entitled to damages depends upon the facts and the law that applies to the situation.

For example it is not clear whether you son was injured or whether he was killed in the accident. Since you are asking about pain and suffering damages for you and his father

it sounds as though your son may not have survived the accident.

You really need to speak with an attorney to help you with these issues.
