Texas DUI
My niece received a DUI ticket. Is there any defense for this offense? She is 17, was driving, was stopped for failure to signal and open containers were in the car. She failed a ''pen'' test administered on the side of the road.

Based on what you have written, there are generally multiple SFST (standard field sobriety tests) which are conducted on an individual who is suspected to driving under the influence. There generally are always questions and potential defenses to any DUI/DWI charge(s) alleged by the District Attorney's Office.
