Legal Question in DUI Law in Texas

go to trial for DWI?

i am 20 years old and last year was arrested for drunk driving when i was pulled over with a headlight out. The officer that gave the test was not the best and claimed that i had taken the wrong number of steps along with other thing that seemed inconsistent.

When my lawyer reviewed the tape he informed me that i had done 99% of what was asked of me correctly. The officer had claimed i had taken 13 steps when i had really only taken the correct number which was 12. My lawyer says that i have about a 50-50 chance if i were to take this case to trial. Please let me know if i can give you more information to help you come to a better decision.

Re: go to trial for DWI?

The reason your attorney has given you a 50/50% chance is because you never know what jurors you are going to get.

If you did do well on the field sobriety tests that video tape can be shown to a jury to let them decide if you were intoxicated or not.

Good DWI lawyers are certified in Standardized Field Sobriety Testing and they know how to cross examine officers' in a way to covey to the jury that you satisfactorily performed the tests.

You should know that DWI's stay with you for life. It is your choice not your attorney's choice of whether or not you should take your case to trial.

If you have any further questions or would like to have your video examined by an expert feel free to contact our office.

Sincerely,

Erick Platten
