TX DUI for Minor
I'm 20 and received a DUI when I was pulled over for speeding. I took a roadside breath test and a small amount of alcohol was detected. However, the officer allowed me to call someone to come pick me up and drive my car home. I have a friend who received a DUI and he did not have to get a lawyer and he also did deferred adjudication. Can I do this and not hire a lawyer? I do not want to hire a lawyer and pay money for something that will just go off my record after I do deferred adjudication and turn 21 in October.

There is no Deferred Adjudication for DWIs there are considerable consequences for a DWI conviction. Hire an attorney!Your license will be suspended for one year.

Mr. Yoakum is wrong, there is a Deferred Adjudication for a minor who is under 21 years of age. However, just getting a Deferred Adjudication is part of the deal, you have 15 days from the date of your arrest to request a hearing as to whether your drivers license should be suspended, called an Administrative License Revocation Hearing. Unfortunately, if you lose this hearing your drivers license will be suspended for 60 days and the suspension does not go off your record. In fact it is considered an alcohol contact, and will be used against you should you ever pick up another DUI or a DWI after you become an adult. I do agree with Mr. Yoakum in that you need to hire a DWI attorney, becuase your career, and life is at stake even if you just think it is just a DUI.
