Legal Question in Elder Law in Texas

I honestly believe a contractor stole a book of checks that my Mother had signed and wrote checks made out to her, her son or company in the tune of $106,000.00. The police say since my mother has since died in June 2008 we don't know for sure that she didn't give her the book of checks. While going through my Mothers affairs in October, I found the returned checks but that is the only book of checks missing. Knowing my Mother, I know that she did not give her the book of checks. Can I sue her for elder fraud? Mother was 90 when this occurred. The same contractor had a bid of $10,000 to paint and carpet a rent house and Mother ended up payning her $54,000. Also she was to build a storage shed for $30,000 and that ended up being in the neightborhood of $60,000 and not completed. I would really like to nail this person to the wall. Do I have any legal recourse?
