PRe-paid funeral arrangements
Grandparents bought pre-paid funeral back in the 80's possibly earlier (Grandpa passed in 88 , Grandma in nursing home almost 94 ) . Now funeral home is saying there is money still due . But we have in our possession papers saying ''completion of contract 6/15/1999 '' with the owners initals next to it . I paid monies I thought were due , because Grandma was near death , and I wanted everything to be ready in case . If contract actually says ''completion of contract signed and dated by the owner . Shouldn't I receive a refund ? I live in Fort Worth Grandma in E. Texas . So I had to fax copies of this to funeral home . I'm thinking if contract was paid in full in 99 . Contract should be still honored right ? And I should get my money back ?

Your question is one of contract law rather than elder law. You may want to resubmit in a different category. I am not a contract attorney, but can say that anyone who helps you would need to read your contract in full before giving an opinion. Contract law is based upon the "four corners" of the document your grandparent signed with the funeral home. I recommend that you have an attorney review the document to see what recourse you have in this situation.
