Can I fictionalize a real life person if they won't give permission to be depicted in my movie?

Yes, that is one of the reasons to fictionalize. It is also important when the story potrays the character in a negative light! The fictionalizing can be good for marketing as people try to figure out the true identities and you refuse to say.
