Legal Question in Entertainment Law in Texas

Can I sue for a hook stolen from a song we recorded years ago. The only difference is one word that has changed, but the hook contains all other words from the hook and is repeated the same way as far as rhythmization of it. I can play both songs back to back and you would be able to tell that this hook came from our original song that was recorded previously. Please advise, Sean Whittington at [email protected].

Based on what you have written, there are a few other items which require some information before a response may be provided. First, after recording the song, was the song copywritten? Second, has the song been published? Third, why do you believe that someone would steal the song? Fourth, has the allegedly stolen material been copywritten? Fifth, has the allegedly stolen material been published? These are just some of the answers which need to be responded to before you could file a ligitmate legal action.

The above response given is not intended to create, nor does it create an on-going duty to respond to questions. Additionally, the response does not form an attorney-client relationship, nor is it intended to be anything other than an educated opinion. It should not be relied upon as legal advice. The response given is based upon the limited facts provided by the person asking the question. To the extent additional or different facts exist, the response might possibly change.
