Legal Question in Family Law in Texas

I have 4 children with my ex. They are now 6, 7,9, & 10. When the older 3 were 1,2, &3 years old they were molested by their dad's brother. Their dad refuses to believe them and tells them to shut up when they try to talk to him about it. I took them to the hospital, to the police dept, and started counseling when they told me about it. The uncle went to jail on separate criminal charges right after this and before I could do anything about the molestation. I just found out he is out of jail and I am in the process of pressing charges on him for that. However, the kids went to see their dad this past weekend and allowed the brother to be there all weekend also. My kids said he didn't do anything to them this time. their dad sees them 1 or 2 times per year for a weekend and is $40,000 behind in child support. I don't see that he cares about their well being at all. Are their any charges i can file on him for allowing the brother to come around them (negligence?) and can I have his right's taken away because of all of this? Please Help

1. If there has been a 12-month period (ending within the past six months) when Dad didn't pay child support, you have grounds for termination of his parental rights.

2. You can file a motion for modification and ask the Court to make an order that Dad can't take the children within 500 yards of their uncle.
