Legal Question in Family Law in Texas

I have 4 kids (diff fathers) and one on the way (bfs baby). My bf was disciplining my son and spanked/hit him. N my 12 yr son seen and doesn't like my bf he told my mother which in return called the police. Police came out and there was no marks on my son but cop said she wasn't going to get CPS involved because there no marks and he had left and I was taking precautions to make sure he won't return. He's not allowed near my kids but I will have his child soon. Can he not come back ever? He didn't hit my son hard and my son really hates him, and wanted him out. I really want to be with my bf but can he not come back and if he can't how can he?

If he's not allowed to be around your children, then you can't be with him except when your children are away. However, if there is no court order preventing him from being around your children, I don't know why he can't come back. Just the police telling him to stay away is not enough.

Just know this: If he abuses your child, you will lost ALL your children.
